Terms of Service

By using Coldpitch, you agree to:

• Comply with all applicable laws, including the CAN-SPAM Act, GDPR, and any other applicable email marketing and data protection regulations.
• Only send emails to legitimate business contacts for lawful B2B outreach purposes.
• Not use the Service to send unsolicited bulk email (spam), phishing messages, malware, or any illegal, harmful, or deceptive content.
• Include accurate sender information and honor unsubscribe requests promptly.
• Not upload or transmit content that infringes on the intellectual property rights of others.
• Not attempt to circumvent sending limits, security controls, or any other restrictions on the platform.

We reserve the right to suspend or terminate accounts that violate these acceptable use policies without notice.

• You are responsible for maintaining the security of your account credentials, including any SMTP credentials you provide to the platform.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.
• You must notify us immediately of any unauthorized use of your account.

• Subscriptions are billed monthly through Stripe. Your plan renews automatically at the end of each billing period unless you cancel.
• You may upgrade or downgrade your plan at any time. Changes take effect at the start of the next billing period.
• Email refill purchases are one-time charges and are non-refundable. Refill balances do not expire and carry over until used.
• We reserve the right to change pricing with 30 days advance notice. Existing subscriptions will continue at their current rate until the next renewal after the notice period.
• You may cancel your subscription at any time from the Settings page. You will retain access until the end of the current billing period.

• Coldpitch uses artificial intelligence to generate email content. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated emails.
• You are solely responsible for reviewing AI-generated content before sending. Emails are sent from your own email accounts and represent your business.
• AI-generated content may occasionally produce inaccurate information, especially when referencing details from prospect websites. You should verify any specific claims before sending.
• We are not liable for any consequences arising from the use of AI-generated email content, including but not limited to reputational damage, lost business, or legal claims.

• We provide the Service on a "best effort" basis. We do not offer a formal Service Level Agreement (SLA) or uptime guarantee.
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• Email delivery depends on third-party email providers and is not guaranteed. We are not responsible for emails that are blocked, filtered, or delayed by recipient email servers.
• We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

To the maximum extent permitted by law, Coldpitch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

• The Coldpitch platform, including its software, design, and branding, is owned by us and protected by intellectual property laws.
• You retain ownership of all data you upload to the platform, including prospect lists and campaign content.
• AI-generated email content is provided for your use. You may use, modify, and send AI-generated emails without restriction.

• You may close your account at any time by contacting support.
• We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for your subscription.
• Upon termination, your access to the Service will be revoked and your data will be deleted in accordance with our Privacy Policy.
• Sections relating to Limitation of Liability, Intellectual Property, and any other provisions that by their nature should survive, will survive termination.
